PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO THESE TERMS. THESE TERMS INCLUDE AN AGREEMENT TO RESOLVE MOST DISPUTES THROUGH INDIVIDUAL BINDING ARBITRATION AND INCLUDE WAIVERS OF JURY TRIALS AND CLASS OR REPRESENTATIVE ACTIONS.

If you do not agree to these Terms, do not use our Services.

1. Eligibility and Acceptance

Our Services are intended for individuals age 18 or older and primarily for use within the United States. By using the Services, you represent that you are legally capable of entering into these Terms.

We may revise these Terms periodically. Updated Terms become effective when posted unless otherwise stated. Your continued use of the Services after an update constitutes acceptance of the revised Terms.

2. Insurance Services

Silver Stream provides insurance-related information and services and may assist consumers with obtaining quotes, applying for insurance, and communicating with insurance carriers and other insurance professionals.

Information available through our website or Services is provided for general informational purposes and does not constitute a guarantee of coverage, pricing, underwriting classification, policy issuance, or benefits.

Insurance products are subject to the terms, conditions, exclusions, underwriting requirements, and approval of the applicable insurance carrier. Availability and product features may vary by state.

Nothing on our website modifies or replaces the terms of an insurance policy or contract. If there is a conflict between information provided through our Services and an issued insurance contract, the insurance contract controls.

3. Permitted Use

Silver Stream grants you a limited, non-exclusive, non-transferable, revocable right to access and use our website and Services for lawful personal or business purposes consistent with their intended use.

You may not:

• Use the Services for unlawful, fraudulent, abusive, or misleading purposes;

Insurance carriers and other third parties may independently verify information and determine eligibility, underwriting classifications, premiums, coverage, and policy issuance.

You are responsible for reviewing insurance applications and policy documents for accuracy before signing or accepting them.

5. Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services or providing information to Silver Stream, you acknowledge the practices described in the Privacy Policy.

6. Intellectual Property

The Silver Stream name, logo, website, designs, graphics, text, software, and other content owned by Silver Stream are protected by applicable intellectual-property laws.

Except for the limited right to use our Services under these Terms, no ownership or intellectual-property rights are transferred to you.

7. Third-Party Services and Insurance Carriers

Our Services may contain links to, integrate with, or provide access to insurance carriers, technology providers, financial professionals, and other third parties.

Those organizations operate independently and may maintain their own terms of use and privacy policies. Silver Stream does not control and is not responsible for third-party websites, systems, products, services, security practices, or content.

A link to or integration with a third party does not necessarily constitute an endorsement of that party.

8. Electronic Communications

By providing your email address, telephone number, or other contact information, you authorize Silver Stream and parties assisting with your requested insurance Services to communicate with you as permitted by applicable law.

You may opt out of marketing emails using the unsubscribe mechanism provided in those communications or by contacting privacy@silverstreamins.com.

Opting out of marketing communications does not prevent communications necessary to respond to your requests, service an insurance transaction, satisfy compliance obligations, or provide other communications permitted by law.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SILVER STREAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

Silver Stream does not guarantee that an insurance carrier will offer, approve, issue, renew, or maintain any particular insurance product or coverage or that any quoted premium will remain available.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILVER STREAM AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, OUR WEBSITE OR SERVICES.

To the maximum extent permitted by applicable law, Silver Stream’s aggregate liability arising from the website or Services will not exceed the greater of the amount you paid directly to Silver Stream for the applicable Service during the six months preceding the claim or $100.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Silver Stream and its owners, officers, employees, contractors, and agents from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, material violation of these Terms, or intentional misrepresentation of information you provide.

12. Suspension and Termination

We may suspend, restrict, or terminate access to our Services when reasonably necessary to protect Silver Stream, our customers, our service providers, or others; comply with law; address security concerns; or respond to a violation of these Terms.

Termination does not affect provisions that by their nature should survive termination, including intellectual-property protections, disclaimers, limitations of liability, indemnification, and dispute-resolution provisions.

13. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Before initiating formal proceedings, you and Silver Stream agree to make a reasonable good-faith effort to resolve disputes informally. Written notice of a dispute may be sent to privacy@silverstreamins.com or to the mailing address below.

Except for matters eligible for small claims court or claims seeking appropriate temporary or injunctive relief, any dispute arising from or relating to these Terms, our Privacy Policy, website, or Services will be resolved through final and binding individual arbitration administered by JAMS under the rules applicable to the dispute.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

ARBITRATION WILL TAKE PLACE ONLY ON AN INDIVIDUAL BASIS. YOU AND SILVER STREAM WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING, JOIN, OR PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION TO THE FULLEST EXTENT PERMITTED BY LAW.

The arbitrator may award any individual remedy that would otherwise be available in court. If any portion of this arbitration provision is determined to be unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

Either party may bring an individual claim in small claims court if the claim qualifies for that court’s jurisdiction.

14. Governing Law

Except where federal law applies or applicable law requires otherwise, these Terms and your use of the Services are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

For disputes not subject to arbitration, you consent to jurisdiction in the appropriate state or federal courts located in Arizona, except where applicable law provides otherwise.

15. U.S. Use

Our Services are intended primarily for use within the United States. Silver Stream makes no representation that its Services or insurance products are appropriate, licensed, or available in every jurisdiction.

Insurance products and Services are offered only where permitted by applicable law and licensing requirements.

16. Severability and Entire Agreement

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

These Terms, together with our Privacy Policy and any applicable product- or service-specific agreements, constitute the agreement between you and Silver Stream regarding your use of our website and Services.

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
